A PIC shall ensure that the following flying equipment …. are accessible for each flight … (2) a Cockpit checklist containing the procedures required by paragraph (b) of this section. Paragraph (b) lists checklists for starting, before takeoff, etc. I guess that doesn’t require use only presence of the checklist?
